IRCC cập nhật một số câu hỏi thường gặp của sinh viên và giải đáp

Questions and Answers – May 2021

1.    Would IRCC interpret differently a program that is completed fully online vs. a program that can be completed fully online, both in terms of its eligibility for a study permit and for a PGWP? If a program is described on an institution’s website as being able to be completed fully online depending on course offerings,

a.       Would a visa officer interpret this program to be an online program and therefore not issue a study permit?

If a student is completing a program that is entirely distance learning, a study permit is not required. Foreign nationals are required to obtain a study permit for engaging in academic, professional, vocational or other education or training that is more than 6 months in duration at a designated learning institution (DLI) in Canada.

The duration of the study permit should be for the duration of the in-Canada portion only. Please note that if the student wants to obtain a PGWP, they will need to apply for a study permit and the application needs to be received prior to beginning studies.

In normal circumstances, distance learning can be considered online learning. Students who complete a program of study exclusively by distance learning (outside or within Canada) are not eligible for a post-graduation work permit.

Due to COVID-19, all students who were enrolled in a PGWP-eligible program in progress in March 2020 or who started a program of study from spring 2020 up to and including the fall 2021 semester can complete up to 100% of their program online from outside Canada.

2. Would a visa officer interpret this program to be ineligible for a PGWP?

Due to COVID-19, officers will have discretion when reviewing online programs and will employ facilitation measures to try and address the current travel restrictions. These facilitative measures will continue to be assessed over time and across different policies.  As long as the student is in a PGWP-eligible program and applied for their study permit prior to beginning studies, they will be eligible for the PGWP.

3. For students who are waiting on high-school results to gain final admission to PSE institutions, can they apply with provisional acceptance? Would the provisional acceptance qualify as a complete application?

We are in consultation with DLI’s and stakeholders to discuss their approach to these situations and will have more to share in the coming weeks.

4. Do students need to submit biometrics for their applications to be considered complete?

a.       What do they do if VACs are closed due to country lockdown?

A biometric instruction letter (BIL) is provided by the applicant as proof that the applicant has already submitted a complete application to an Immigration, Refugees and Citizenship Canada (IRCC) office and paid the biometric fee (unless the applicant is exempt from paying the fee). As a temporary measure, IRCC has made some changes to biometrics requirements. Students are exempt from the requirement to give biometrics if they

·       are in Canada and are applying to work, study or stay temporarily in Canada

·       are applying or have applied for permanent residence and have given biometrics within the last 10 years

Most VACs have temporarily closed or are operating with limited hours and services. Students should check the VAC website before they go.

5. Do students need to have upfront medical exam results for their applications to be considered complete? Should students do an upfront medical exam?

Students have the option of getting an exam before they apply. This is called an upfront medical exam. To get one, students should contact a panel physician directly.

Student can get one if they apply to:

·       visit (including parent and grandparent super visa)

·       work

·       study

IRCC will send the student instructions on how to get medical exams done. The student must go for the medical exam within 30 days of receiving these instructions. If the student does not follow these instructions, we may refuse their application.
